The order of dividing an estate

  1. Funeral and burial costs are paid first, then debts.
  2. Any bequest to a non-heir is carried out, up to one third of what remains.
  3. The rest is divided among the heirs: those with fixed shares first (such as 1/2, 1/4, 1/8, 2/3, 1/3 and 1/6), then the residuary heirs take what is left, with a male receiving twice the share of a female.

Awl and radd

Awl (proportional reduction): if the fixed shares add up to more than the estate, every fixed share is reduced in proportion. Radd (return): if something is left and there is no residuary heir, the remainder goes back to the fixed-share heirs in proportion to their shares, except the spouses.
